The data protection declaration of La Chopperia Customshop is based on the terms used by the European legislator for directives and regulations when the GDPR was issued. Our data protection declaration should be legible and understandable for the general public as well as for our customers and business partners. To ensure this, we would like to explain the terms used in advance.

A processor is a natural or legal person, public authority, agency or other body that processes personal data on behalf of the person responsible.

f) Recipient
A recipient is a natural or legal person, public authority, agency or other body to which personal data is disclosed, regardless of whether it is a third party or not. However, authorities that may receive personal data in the context of a specific investigation mandate under Union or Member State law are not considered recipients.

g) third party
A third party is a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct responsibility of the controller or the processor, are authorized to process the personal data.

h) Consent
Consent is any expression of will voluntarily given by the data subject in an informed manner and unequivocally for the specific case in the form of a declaration or other clear confirmatory action with which the data subject indicates that they are processing the personal data concerning them agrees.

When making an inquiry via the contact form or requesting an offer, you agree to the collection, processing and use of your personal data in accordance with the data protection declaration of consent. Consent is voluntary and revocable at any time.

La Chopperia Customshop collects its data for the purpose of preparing offers, executing orders and contracts and fulfilling its contractual and pre-contractual obligations. 

The data collection and data processing is necessary for the processing of your request or for the preparation of the offer or the contract and is based on Article 6 Para. 1 b) DSGVO. The data will only be passed on to third parties for the purpose of preparing an offer or executing an order and to fulfill legal obligations. The data will be deleted as soon as they are no longer required for the purpose of their processing and after the statutory retention periods have expired. 

Names, addresses, telephone and fax numbers as well as e-mail addresses, item numbers and bank details may be stored and processed for the purposes stated above.

Orders through our website

You can either place orders as a guest via our website without registering, or register as a customer in our shop for future orders. Registration has the advantage for you that in the event of a future order you can log in to our shop directly with your e-mail address and password without having to re-enter your contact details.

Your personal data is entered into an input mask and transmitted to us and stored. If you place an order via our website, we first collect the following data, both in the case of a guest order and in the case of registration in the shop:

  • Salutation, first name, last name,

  • a valid email address,

  • Address,

  • Telephone number (landline and/or mobile)

This data is collected

  • to be able to identify you as our customer;

  • to process, fulfill and process your order;

  • to correspond with you;

  • for invoicing;

  • to process any liability claims that may exist and to assert any claims against you;

  • to manage our customer data.

The data processing takes place upon your order and/or registration and is in accordance with Art. 6 para -5cde-3194-bb3b-136bad5cf58d_b DSGVO for the purposes mentioned for the appropriate processing of your order and for the mutual fulfillment of obligations from the purchase contract.

The personal data collected by us for the processing of your order will be stored until the end of the statutory retention period and then deleted, unless we, according to Article 6 Abs. 1 S. 1 lit. c DSGVO due to tax and commercial storage and documentation obligations (from HGB, StGB or AO) are obliged to store longer or you are in any further storage according to Art have consented.

Sharing of Data

LEGAL BASIS OF PROCESSING

Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If our company is subject to a legal obligation that requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party.
